IMPORTANT: THIS DISCLAIMER CONTAINS LIMITATIONS OF LIABILITY AND AFFECTS YOUR LEGAL RIGHTS. PLEASE READ CAREFULLY.

1. No Warranty for Existing Equipment. LA Construction Heating & Air Conditioning Comfort Club ("Club") Membership does not constitute an express or implied warranty on any existing HVAC system or equipment you currently own ("Equipment"). This includes, but is not limited to, furnaces, air conditioners, heat pumps, humidifiers, and any other equipment related to your heating and cooling system.

2. Non-Coverage of Warranty Costs for Non-LA Construction Installed Equipment. LA Construction Heating & Air Conditioning("Company") will not be responsible for, nor will it cover any warranty costs associated with Equipment not installed by the Company. This includes any labor or parts associated with such warranty claims.

3. Sole Responsibility of Original Installer for Warranty Claims. All warranty claims for Equipment must be made directly with the original installing company. You are solely responsible for pursuing any warranty claims with the original installer and for complying with their warranty claim procedures. The Company makes no representations or warranties regarding the enforceability or validity of any warranty offered by the original installer.

4. Automatic Cancellation of Plan. If another company works on repairs, or services any HVAC system, furnace, air conditioner, humidifier, or any other related equipment, or installs new equipment without prior authorization from LA Construction Heating & Air, this maintenance plan will be automatically canceled, and no refunds will be issued.

5. Automatic Renewal: Maintenance plans are renewed automatically and will be charged to the card on file unless canceled at least 7 days before renewal. Monthly plans can only be canceled after completing all 12 payments for the plan year. By enrolling, you agree to these terms.

6. Entire Agreement; Non-Waiver. This Disclaimer constitutes the entire agreement between you and the Company regarding the limitations of liability set forth herein and supersedes all prior or contemporaneous communications, representations, or agreements, whether oral or written. No waiver by the Company of any breach of this Disclaimer shall constitute a waiver of any other or subsequent breach.

7. Your Acceptance. By enrolling in the Club, you acknowledge that you have read and understood this Disclaimer and agree to be bound by its terms and conditions. You further acknowledge and agree that this Disclaimer is a material inducement to the Company to provide you with Club membership.

8. Governing Law. This Disclaimer shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.
